Job Description
Job Purpose
The Licensing Manager (Legal and Regulatory) will be responsible for managing and coordinating the Authority’s licensing functions in the communications sector. The position involves overseeing licensing processes, drafting and reviewing licences and regulatory instruments, ensuring compliance with applicable legal and regulatory frameworks, and providing legal and regulatory advisory services to internal and external stakeholders.
Key Responsibilities
- Managing and overseeing the processing, evaluation, issuance, renewal, amendment, suspension, and revocation of communications licences in accordance with applicable laws, regulations, and the Authority’s policies.
- Coordinating and facilitating licensing procedures and ensuring that all licensing applications are processed efficiently, transparently, and within prescribed timelines.
- Drafting, reviewing, and negotiating communications licences, authorizations, agreements, and other legal and regulatory instruments.
- Providing legal and regulatory advice, guidance, and interpretation on licensing matters to management, licensees, prospective applicants, and other stakeholders.
- Monitoring licensees’ compliance with licence terms and conditions, regulatory obligations, and applicable legal requirements.
- Coordinating periodic assessments, inspections, and reviews of communications licensees to ensure continued compliance and performance.
- Developing, reviewing, and recommending improvements to licensing frameworks, procedures, guidelines, and regulatory processes in line with emerging sector developments and best practices.
- Managing and maintaining licensing databases, registers, and records to ensure accuracy, integrity, accessibility, and confidentiality of information.
- Collaborating with relevant departments in addressing regulatory, legal, and compliance issues affecting licensees and the communications sector.
- Supporting the development, drafting, and review of regulations, rules, directives, guidelines, policies, and other regulatory instruments of the Authority.
- Conducting legal and regulatory research and preparing reports, opinions, briefs, and recommendations on licensing and sector-related matters.
- Engaging and maintaining effective working relationships with government institutions, industry stakeholders, licensees, legal practitioners, and other relevant partners.
- Assisting in the management of disputes, litigation, and enforcement matters relating to licensing and regulatory compliance.
- Performing any other duties as may be assigned from time to time.
Requirements
Qualifications and Experience
- Master of Laws (LLM) Degree from a recognized institution.
- Bachelor of Laws (LLB) Degree from a recognized institution.
- Must be admitted to the bar and possess a valid legal practising licence in Malawi.
- Minimum of five (5) years’ post-admission relevant professional experience in licensing, communications regulation, regulatory compliance, legal practice, litigation, or related areas.
- Experience in the communications, ICT, or regulatory sector will be an added advantage.
